Hostmargin – Service Specific Terms & Conditions

These Service-Specific Terms form an integral part of the Master Terms & Conditions of Hostmargin (“Company”, “we”, “our”, “us”). By purchasing, accessing, or using any Hostmargin service, the Customer (“Client”, “User”) agrees to be legally bound by these terms in addition to the general Terms of Service. In the event of any conflict, these Service-Specific Terms shall prevail for the respective service category.


1. Shared Hosting Terms

1.1 Nature of Service

Shared Hosting services are provided within a multi-tenant server environment. Server resources including CPU, RAM, disk I/O, bandwidth, and storage are shared among multiple customers. While Hostmargin implements monitoring and resource balancing mechanisms, performance may vary depending on overall server utilization.

1.2 Fair Usage Policy

Shared Hosting accounts are intended for standard website operations. The following activities are strictly prohibited:

  • Excessive consumption of CPU, RAM, or disk I/O resources.
  • Cryptocurrency mining or blockchain-related processing.
  • High-load SaaS platforms, large-scale APIs, or streaming services.
  • Running persistent background daemons or cron jobs that affect server stability.

Hostmargin reserves the right to throttle, suspend, or terminate accounts that negatively impact overall server performance.

1.3 Email Service Policy (Manual Activation Required)
Email functionality is disabled by default on all shared hosting accounts.

To enable outgoing email services, Clients must submit a formal request including:
  • Clear purpose of email usage
  • Expected sending volume (per hour/day)
  • Nature of emails (transactional, support, internal business communication, etc.)
Hostmargin reserves the sole right to approve, restrict, rate-limit, or deny email activation requests to protect server IP reputation and prevent abuse.

Bulk marketing, unsolicited email campaigns, purchased mailing lists, and spam-related activity are strictly prohibited unless explicitly authorized.
1.4 Backups

Weekly backups may be provided as a courtesy service. However, backup availability, completeness, or restoration success is not guaranteed. Clients are solely responsible for maintaining independent and secure backups of all website data, emails, and databases.

1.5 Suspension & Enforcement

Hostmargin may suspend or terminate accounts without prior notice in cases of:

  • Non-payment of services
  • Malware infection or compromised scripts
  • Spam complaints or blacklist incidents
  • Violation of Acceptable Use Policy
  • Legal or regulatory complaints

2. Reseller Hosting Terms

2.1 Responsibility for End Users

Resellers are fully responsible for the actions, content, billing, and compliance of their end-clients. Hostmargin does not provide direct support to reseller customers.

2.2 Abuse & Compliance

In the event of abuse originating from a reseller account, Hostmargin will notify the reseller. If the issue is not resolved within 24 hours, Hostmargin reserves the right to suspend the specific account or the entire reseller package.


3. VPS Hosting Terms

3.1 Customer Responsibility

VPS Hosting provides isolated virtual server environments with root access. Clients assume full responsibility for server configuration, software installation, security hardening, firewall configuration, and patch management.

  • Weak passwords leading to compromise are the Client’s responsibility.
  • Failure to apply security updates may result in suspension.
3.2 Managed vs Unmanaged Services

Unmanaged VPS includes infrastructure-level support only. Managed VPS includes limited operating system and control panel support as defined in the purchased plan.

3.3 Prohibited Activities
  • DDoS attacks or participation in botnets
  • Port scanning or brute-force attacks
  • Phishing pages or malicious software hosting
  • Cryptocurrency mining operations

4. Dedicated Server Terms

4.1 Hardware Ownership & Access

All hardware remains the property of Hostmargin or its datacenter partners. Physical access to hardware is not permitted unless contractually agreed.

4.2 Hardware Failure & SLA

Hardware replacement is performed within the defined SLA timeframe. Compensation, if applicable, shall be limited to service credits only and shall not include monetary refunds for indirect losses.

4.3 Licensing Compliance

Clients must ensure that all installed software and applications are properly licensed. Any legal claims arising from licensing violations shall be the sole responsibility of the Client.


5. Domain Name Registration Terms

5.1 Registry Compliance

All domain registrations are subject to ICANN policies and respective registry rules. Hostmargin acts as an intermediary between the Client and the accredited registrar.

5.2 Accuracy of Information

Clients must provide accurate and up-to-date WHOIS information. False or misleading information may result in domain suspension or cancellation.

5.3 Renewals & Refunds

Clients are solely responsible for renewing domains prior to expiration. Domain registrations, renewals, transfers, and redemption fees are non-refundable once processed.


6. Limitation of Liability

Under no circumstances shall Hostmargin be liable for indirect, incidental, consequential, or special damages, including but not limited to data loss, loss of revenue, loss of business opportunity, or reputational harm. Total liability shall not exceed the amount paid by the Client for the affected service during the last billing cycle.

7. Indemnification

The Client agrees to indemnify, defend, and hold harmless Hostmargin from any claims, damages, legal actions, fines, or liabilities arising from misuse of services, hosted content, or violation of applicable laws.

8. Force Majeure

Hostmargin shall not be liable for service interruptions caused by events beyond its reasonable control, including natural disasters, governmental actions, cyber attacks, war, internet backbone failures, or datacenter outages.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Kerala.
